4. Prohibited Activities

  • Reselling ThemeVault themes as standalone products or competing digital downloads.

  • Using ThemeVault products to create deceptive, illegal, infringing, or harmful online stores.
  • Using stolen payment methods, chargeback abuse, or fraudulent purchase behavior.

5. Intellectual Property and Theme Licenses

All content on ThemeVault, including website text, graphics, branding, logos, product previews, screenshots, documentation, theme files, code, designs, and digital assets, is owned by ThemeVault, its creators, licensors, or partners and is protected by intellectual property laws.

When you purchase a theme, you are buying a license to use that theme, not ownership of the underlying intellectual property. Unless otherwise stated on the product page or license file, your purchase grants you a limited, non-exclusive, non-transferable license to download and use the theme for your own Shopify store or client project, subject to the applicable license terms.

You may not claim ownership of ThemeVault products or creator products. You may not register, trademark, copyright, or otherwise assert exclusive rights over any theme, design, codebase, template, or asset obtained through ThemeVault.

6. Payments, Pricing, and Downloads

Payments are processed through third-party payment providers such as Stripe. By making a purchase, you agree to provide accurate billing information and authorize the applicable payment provider to charge your selected payment method.

Prices, discounts, bundles, and product availability may change at any time. We may correct pricing errors, product errors, or checkout errors before or after purchase where legally permitted.

After successful payment, digital products are usually made available through your account, purchase receipt, or download page. You are responsible for downloading and safely storing your purchased files.

Download access may be limited by time, number of downloads, account status, license terms, fraud prevention rules, or technical restrictions. We may suspend download access if we detect abuse, unauthorized sharing, payment disputes, or violations of these Terms.

7. Refunds and Digital Product Policy

Unless required by applicable law or stated in our refund policy, we do not guarantee refunds for buyer’s remorse, lack of Shopify experience, incompatibility caused by third-party apps, custom modifications, or failure to read the product description before purchase.

Product updates, support periods, documentation, and compatibility details may vary by product. Any support we provide is offered according to the product page, license terms, or support policy in effect at the time.

We aim to describe products accurately, but we do not guarantee that every theme will be compatible with every Shopify store, app, browser, device, customization, third-party integration, or future Shopify platform change.

Theme compatibility may be affected by Shopify updates, installed apps, custom code, hosting issues, browser changes, user modifications, or third-party services outside our control.

9. User-Generated Content and Reviews

ThemeVault may allow users to submit reviews, ratings, comments, testimonials, feedback, or other content. By submitting content, you represent that your content is truthful, lawful, and does not infringe the rights of others.

You grant ThemeVault a worldwide, non-exclusive, royalty-free license to use, display, reproduce, edit, publish, and distribute your submitted content for website, marketing, moderation, and business purposes.

We may remove, edit, reject, or moderate user-generated content at our discretion, including content that is abusive, misleading, spammy, unlawful, promotional, irrelevant, or otherwise inconsistent with these Terms.

ThemeVault may link to or integrate with third-party platforms, including Shopify, Stripe, WordPress, Easy Digital Downloads, email providers, analytics tools, and creator websites.

We are not responsible for third-party websites, services, policies, outages, payment processing issues, platform changes, or actions taken by third-party providers.

11. Disclaimers

ThemeVault products and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and compatibility.

We do not guarantee that a theme will increase sales, improve conversion rates, meet your business goals, work with all third-party apps, or remain compatible with future Shopify updates.

You are responsible for reviewing product details, testing themes, backing up your store, maintaining your Shopify environment, and ensuring that any theme meets your business, technical, legal, and compliance needs.

12. Limitation of Liability

To the fullest extent permitted by law, ThemeVault and its owners, team members, creators, licensors, partners, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, business interruption, or loss of goodwill.

To the fullest extent permitted by law, our total liability for any claim relating to ThemeVault, our website, or any purchased product will not exceed the amount you paid for the specific product giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless ThemeVault, its owners, team members, creators, licensors, partners, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from your use of ThemeVault, your breach of these Terms, your violation of law, your user-generated content, or your misuse of any theme or digital product.
